1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and RegnaVita ("Company", "we", "us", or "our") concerning your access to and use of the Chinese Forge mobile application, website, and related educational services (collectively, the "Service").

By downloading, installing, accessing, or using Chinese Forge, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with all of these Terms, you must immediately cease using the Service and uninstall the application.

2. Universal Eligibility & Account Registration

Universal Educational Access: Chinese Forge is a family-friendly educational platform designed for language learners of all age groups. We do not enforce age barriers. For minors and young learners, access to the application and any store transactions should be conducted under parental or legal guardian supervision in compliance with applicable local laws.
Account Types:
- Guest Anonymous Sessions: You may use Chinese Forge as a guest without creating an account. Your learning records are tied locally to your device session.
- Authenticated Accounts: You may link your study progress to a permanent account via passwordless email OTP (One-Time Password / Magic Link), Google Sign-In, or Sign in with Apple.
Account Security: You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

3. Educational Services & Intellectual Property

License Grant: RegnaVita grants you a revocable, non-exclusive, non-transferable, personal limited license to download, install, and use Chinese Forge solely for your individual language learning purposes.
Proprietary Content: All curriculum materials, graded reader articles, etymology breakdowns, character stroke animations, visual memory mnemonics, audio recordings, graphic assets, software code, and our custom Free Spaced Repetition Schedule (FSRS) algorithm integration are the exclusive intellectual property of RegnaVita and its licensors.
Strict Usage Restrictions: You agree not to:
- Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App.
- Scrape, extract, or bulk harvest vocabulary dictionaries, curriculum materials, or audio files for external datasets, commercial distribution, or AI model training.
- Rent, lease, sell, sublicense, or distribute the App or its proprietary content.
- Interfere with or compromise the security, integrity, or availability of our backend APIs or infrastructure.

4. Scholar Premium Subscriptions & Billing

Chinese Forge offers optional enhanced features ("Scholar Premium"), including unlimited graded reader content, HSK dictionary lookups, character handwriting forge, offline downloads, and multi-device cloud synchronization.

A. Subscription Plans & Access Passes

Auto-Renewing Subscriptions: Available in Monthly and Annual recurring billing intervals.
Fixed-Term Access Passes: Available as non-renewing access passes (e.g., 3-Month Access Pass).
Pricing: Displayed clearly inside the App prior to purchase in your local currency as determined by the Google Play Store or Apple App Store.

B. 7-Day Free Trials (Apple Review Guideline 3.1.2 & Google Play Compliance)

If an Annual subscription includes a 7-Day Free Trial, you will enjoy full Scholar Premium access during the trial period.
Conversion to Paid Subscription: Unless cancelled at least 24 hours prior to the conclusion of the 7-day trial period, your free trial will automatically convert into a paid recurring annual subscription, and your payment method on file with Google Play or Apple ID will be charged.

C. Automatic Renewal Terms

Recurring Billing: Subscriptions automatically renew at the conclusion of each billing period (monthly or annually) unless auto-renewal is disabled at least 24 hours before the end of the current billing cycle.
Billing Window: Your Apple ID or Google Play account will be charged for renewal within the 24 hours prior to the end of the current period at the rate established at the time of purchase.
Price Modifications: If subscription rates change, you will receive advance notice from Google Play or Apple, and you will have the opportunity to accept or cancel prior to renewal.

D. Managing & Cancelling Subscriptions

Subscriptions cannot be cancelled from inside the Chinese Forge app code directly; they must be managed via your platform's store settings:

On Android (Google Play Store): Open Google Play Store → Tap Profile icon (top right) → Payments & subscriptions → Subscriptions → Select Chinese Forge → Tap Cancel subscription.
On iOS (Apple App Store): Open device Settings → Tap Apple ID / Name → Subscriptions → Select Chinese Forge → Tap Cancel Subscription.
Access Upon Cancellation: If you cancel an active subscription, you will maintain full access to Scholar Premium features until the end of your current paid billing period.

E. Refunds & In-App Purchases

All payments, billing transactions, and refund requests are governed exclusively by the refund policies of the platform where the purchase occurred (Google Play Store or Apple App Store). RegnaVita does not directly process payments or issue cash refunds.

F. Restore Purchases

You can restore your valid previous purchases across all your devices at any time using the "Restore Purchases" button located on the Paywall and Profile screens.

5. User Data & Account Deletion

You retain complete ownership over your learning data. You may permanently delete your account and all associated cloud study records at any time:

In-App Deletion Path: Profile screen -> Account Settings (top right icon) -> Account Security (bottom) -> Delete Account.
Web Deletion Portal: Visit our dedicated portal at https://chineseforge.regnavita.com/delete-account or email hello@regnavita.com from your registered account email address.

Subscription Reminder: Deleting your Chinese Forge account purges your cloud learning data, but it does not cancel recurring subscriptions managed by the Apple App Store or Google Play Store. Subscriptions must be cancelled in your store settings.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise. RegnaVita expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and linguistic accuracy.

While we strive to provide the highest caliber Chinese language learning resources, we do not guarantee specific educational outcomes, HSK exam scores, or fluency levels.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall RegnaVita, its directors, employees, partners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

In no event shall our total aggregate liability exceed the greater of $50.00 USD or the total monetary amount paid by you to Chinese Forge in the twelve (12) months preceding the claim.

8. Apple App Store Specific Terms (Standard EULA Minimum Terms Schedule)

If you download or access Chinese Forge from the Apple App Store, the following terms apply:

8.1 Acknowledgment: You and RegnaVita acknowledge that these Terms are concluded between you and RegnaVita only, and not with Apple Inc. RegnaVita, not Apple, is solely responsible for the App and its content.
8.2 Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
8.3 Maintenance & Support: RegnaVita is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance or support services.
8.4 Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever.
8.5 Third-Party Beneficiary: You and RegnaVita acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that Apple will have the right to enforce these Terms against you.

9. Termination

We reserve the right to suspend or terminate your access to Chinese Forge immediately, without prior notice or liability, for any breach of these Terms. Upon termination, your right to use the Service will immediately cease.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RegnaVita operates, without regard to its conflict of law principles. Any legal action arising out of or related to these Terms shall be instituted exclusively in the competent courts of that jurisdiction.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting an updated version on our website and updating the "Last Updated" timestamp.
